With little public attention or even notice, the House of Representatives has passed a bill that undermines enforcement of the First Amendment's separation of church and state. The Public Expression of Religion Act - H.R. 2679 - provides that attorneys who successfully challenge government actions as violating the Establishment Clause of the First Amendment shall not be entitled to recover attorneys fees. The bill has only one purpose: to prevent suits challenging unconstitutional government actions advancing religion.
A federal statute, 42 United States Code section 1988, provides that attorneys are entitled to recover compensation for their fees if they successfully represent a plaintiff asserting a violation of his or her constitutional or civil rights. For example, a lawyer who successfully sues on behalf of a victim of racial discrimination or police abuse is entitled to recover attorney's fees from the defendant who acted wrongfully. Any plaintiff who successfully sues to remedy a violation of the Constitution or a federal civil rights statute is entitled to have his or her attorney's fees paid.

It was two Supreme Court decisions, Hamdi v. Rumsfeld and Hamdan v. Rumsfeld, that compelled the creation of this legislation. The Hamdi decision held that a prisoner has the right of habeas corpus, and can challenge his detention before an impartial judge. The Hamdan decision held that the military commissions set up to try detainees violated both the Uniform Code of Military Justice and the Geneva Conventions.
In short, the Supreme Court wiped out virtually every legal argument the Bush administration put forth to defend its extraordinary and dangerous behavior. The passage of this legislation came after a scramble by Republicans to paper over the torture and murder of a number of detainees. As columnist Molly Ivins wrote on Wednesday, "Of the over 700 prisoners sent to Gitmo, only 10 have ever been formally charged with anything. Among other things, this bill is a CYA for torture of the innocent that has already taken place."
It seems almost certain that, at some point, the Supreme Court will hear a case to challenge the legality of this legislation, but even this is questionable. If a detainee is not allowed access to a fair trial or to the evidence against him, how can he bring a legal challenge to a court? The legislation, in anticipation of court challenges like Hamdi and Hamdan, even includes severe restrictions on judicial review over the legislation itself.

Russia, pledging to complete the Bushehr reactor, has offered to sell a range of surface-to-air missile systems to protect Iran’s nuclear facilities, the Middle East Newsline reports.
Russian diplomatic and industry sources said Moscow has been negotiating to sell Iran a range of anti-aircraft systems to protect Bushehr from Israeli or U.S. air strikes. The sources said contracts could be signed when Bushehr was ready to begin operations in a move expected to take place in late 2007.
“Russia has already installed and manned SAM systems around Bushehr,” a diplomatic source said. “The current talks regard an air defense umbrella that would protect all strategic sites in Iran.”
In November 2005, Russia reached agreement for the sale of 29 TOR-M1 short-range anti-aircraft systems to Iran in a deal valued at more than $700 million. Last week, (mid August 2006) a very serious event transpired at the Buenos Aires international airport which the local mainstream press did not however bring to the attention of the public. Today, Red Kalki, relying on reliable sources, brings this matter into the open.
On Wednesday 9th August 2006, Ezeiza airport police arrested an important Israeli diplomat carrying a considerable quantity of explosives. The Zionist representative was en route to Chile and was detained minutes before boarding a plane. Despite his protests, airport police arrested him and informed the Argentine interior ministry of the situation which ordered that the situation be contained.
Firstly, it should be noted that the airport police, all ex aeronautical military police, were previously under the control of the Defence ministry and military command. Since the 'Four winds' (drugs) scandal however, control of this unit has passed to political funcionaries of the Kirchner (Argentine President) government. For various reasons, the unit is experiencing serious problems, among which is the precarious nature of their job security caused by the many failures of their new bosses in the interior ministry of the Krichner government and the many conflicts between the two.
According to various airport sources, including the members of the airport security unit, a verbal argument erupted between members of the unit and and members of the Krichner government who wanted to free the Israeli diplomat because there was no precedent for this type of arrest, which included the implication that if anything were happen as a result of the release of the bomb-laden Israeli diplomat, the blame would fall on the airport security unit.
Towards the invention of a "third attack"
For years, various reporters and indepdendent researchers have been highlighting the false nature of the "attacks" on the Israeli embassy in Argentina and on the headquarters of AMIA (Argentine Israelite Mutual Association which was "truck bombed" in July 1997 and the blame placed on Hizb'allah)

He will be looking out on an assembly that will be poised to deliver the United States and Mr. Bush a humiliating defeat. The United States is losing in its effort to have Guatemala take over the Latin American seat on the UN Security Council. Venezuela is now favored to win the seat over the objections of US ambassador John Bolton, whose permanent nomination to be ambassador has been killed by the Senate for the current session, and the efforts of Guatemala's Foreign Minister and close Bush administration ally, Gert Rosenthal. Guatemala has among the worst human rights records in Latin America and its government is rife with evangelical fundamentalist Christians and Opus Dei Catholics. Its security services possess the latest in population surveillance technology thanks to Israeli companies like Tadiran.

The US ambassador to Nicaragua has issued a vigorous warning to this small Central American country’s electors against supporting Daniel Ortega, the veteran leftwing Sandinista leader and the frontrunner in November’s presidential election.
In a frank interview with the FT, Paul Trivelli said Mr Ortega was “undemocratic” and would roll back much of the advances made in recent years. And, underlining the concern felt in Washington about the regional influence of President Hugo Chávez of Venezuela, the ambassador said he had no doubt that Venezuela was playing an important role in the election.
“It’s one thing to be truly democratic. It’s another thing to do what the Republicans really have done, which is to distort and manipulate democracy for partisan and personal benefit,”

WASHINGTON - Interior Department officials realized in 2000 that their offshore lease agreements with oil companies shortchanged American taxpayers, but they covered up their multibillion-dollar mistake for six years, an investigator said Wednesday.
After combing through 11,000 e-mail messages and interviewing 29 current and former Interior Department employees, federal investigators still aren't ready to say who they think told a staffer to omit contract language that would have forced oil companies operating in the deep waters of the Gulf of Mexico to pay billions of dollars in royalty payments as energy prices rose.
"Although we have found massive finger-pointing and blame enough to go around, we do not have the proverbial 'smoking gun,' " Interior Department Inspector General Earl Devaney told a House panel Wednesday.
"However, we do have a costly mistake."

The object is basically public relations. Domestic use would make it easier to avoid questions from others about possible safety considerations, said Secretary Michael Wynne.
"If we're not willing to use it here against our fellow citizens, then we should not be willing to use it in a wartime situation," said Wynne. "(Because) if I hit somebody with a nonlethal weapon and they claim that it injured them in a way that was not intended, I think that I would be vilified in the world press."

U.S. officials said they didn't have enough evidence to charge the former taxi driver with terrorist offenses. The Australian government has insisted that Mr. Habib trained with al-Qaida and had prior knowledge of the September 11, 2001 attacks in the United States.
